I'm still waiting for my HRA master card. Via didn't transfer the money over to Optum until Feb 17, 2023. I've had to pay out of pocket for my premiums & co-pays & am furious because they have no idea when the cards will be printed or mailed out. There's a $750 deductible on the Advantage Plus plans, & I've had to pay all my co-pays out of pocket as well. I had Plan G with Anthem (before this terrible maneuver forcing us onto Medicare Advantage via United) & I had NO co-pays at all. It's total insanity that those of us on fixed incomes have to wait for our funds.

And does anyone believe this wasn't going on before 2017 under Rometty? Of course it was which is why there were so many layoffs and unpaid sales commissions. I truly hope there is karma.

Not necessarily a large payout bc it wasn't a wrongful death lawsuit. In the case of a deceased employee, the estate sadly only gets back pay - no front pay, interest or damages that a person who is alive would get.

Nor does it apply to the incompetent managers brought in to select, "set up" high performing employees (some of which were asked to pick people to lay off but either refused bc they had a conscience or retired). The real story still hasn't been told. The employees doing the layoffs were also "dinobabies," & sold their souls, destroyed families, just to get promoted (the reward).

I've read every filing, motion and decision and I have to say that this case is bizarre. I'm not on IBM's side EVER, but Schenfeld does not seem to fit the parameters of age discrimination. He did not meet any criteria but one in filing a state lawsuit in NJ. He was belligerent, nasty and condescending to co-workers; did not perform the work given to him; and when asked to produce a work plan, he provided lists. It's almost like he was begging to be laid off. Every other case, the plaintiffs were set up by upper management and were high performers. I think the mistake this guy made was suing all his superiors. They produced the emails. It shows that IBM will even pay off people who did possibly deserve to be laid off, just to keep Rometty and Gherson's emails from getting out.

HR kept llsts. The lists funneled down to managers instructed to do layoffs (some of them were incompetent, less educated than the employees picked for layoffs). In some cases, they were brought in to create a hostile workplace; give out wrong meeting dates/times; switch clients around - sales ppl were given new clients who IBM knew would not buy their outdated software. These managers, in turn, got promoted (so egregious). One example, is sales compensation. IBM NEVER put in writing there was a cap on commissions. Some sales people were owed up to $1mil in commissions. When they open doored, they were told there was a cap of $10-20K which was total BS. Some of those people got put on a list for layoff or firing, and were RA'd.

One case in WA, Kingston v IBM, was about a white man getting a $1mil commission (didn't happen on the east coast, thus, the sales commission lawsuits there) and a black man, Scott Kingston, not getting $2.4mil in back commissions (he got $275K which is a huge chunk of change compared to the measley $10-20K in NYC). The manager told IBM to pay to pay Kingston or they would be facing a racism lawsuit. IBM ignored the manager and Kingston and fired both of them. The manager won $11mil in his lawsuit ($6mil for pain and suffering), and Kingston settled.

The shareholders attorneys should subpoena everyone that settled with IBM. They refuse to let anyone go to trial. They'll wait until the last hour and then offer cheap settlements. They are despicable. Rometty and Gherson should be jailed.

They should jail these SOBs, because Rometty, Gherson et al were involved in the 'DINOBABIES," and getting rid of the "MATERNAL WORK FORCE," scheme. In the "Layoffs" section of this article, it specifically said they cut corners and did layoffs and cut sales commissions. For what???? To pay these %^&#@! Millions weren't enough for them, but destroying people's lives was? I pray for Karma after what they did to all these laid off employees and their families.

I wonder what IBM's idea of a settlement is? Ginni Rometty & crew should personally be sued en masse. She destroyed people's lives, and in the Lohnn case, they have a death on their hands. Meanwhile, Rometty & Gherson are still making millions. They should hang their heads in shame.

The younger generation job hops which the older generation never thought to do, because it looked bad on your resume. There is zero loyalty among the young, because they are being recruited at a faster pace than older workers. Younger people simply don't have the experience or rapport to deal with clients. The kids today prefer texting or emailing and NO phone contact. How in heaven's name would they be able to build client relationships. It's a generational thing, and older workers are much better at this in sales.

That is exactly what they did to the sales people. Top performers were suddenly switched to customers IBM knew wouldn't buy a thing. Employees who made the 100% club year after year selling multi-million dollars worth of software year after year and NOT getting the commissions they deserved. IBM scammed them. IBM brought in managers that would get paid heftily with promotions if they targeted, set people up & laid them off. They didn't even give them six months to get up to speed. Some did meet 100% quota defying the odds and STILL got laid off. They talked down to and created a hostile environment for people with much more education and experience then those that were brought in to do the head chopping. They would give wrong meeting times and dates, and they gunned for the unprotected class (the majority older white men). And it gets worse. There were many African Americans who were not performing. Their managers treated them with kid gloves and took good care of them. They were the first to scream "if I get fired, I'll sue for racism/sexism." However, there were African American women laying off white men, and they could have sued for racism/sexism, but they knew it wouldn't fly and THEY would be called racists. One man, at another corp, did sue for exactly that and won. But hopefully all this info will come out from the lawsuits and litigants. It's outrageous. People will be shocked.

Everyone should be exposed and DEPOSED. For some reason, Rometty thinks she's exempt. No one has been able to depose her yet, but hopefully, one of the lawsuits will get it done. Rometty (now making millions sitting on various boards), and Gershon (teaching at Harvard Biz School - the irony) should be sued personally bc they were behind the Dinobabies fiasco and destroyed people's lives. They lost their homes, health care, 401K's, unemployment when it ran out because people weren't able to find work, and one (that we know of), took his life. The Kinney case is a must read for details on every one of the 15 litigants. It would turn anyone's stomach. The attorneys beautifully outlined the "scheme" IBM created on how to get rid of employees. IBM, Rometty, et al should hang their heads in shame.I truly hope everyone who may get the chance to sue (only judges can rule on whether someone can sue or not) wins big and IBM crashes and burns for the horror they caused great employees.

It is tragic that this insensitive you know what can never be deposed. Several cases tried to do it, but they can't get to her. She, Gershon (now teaching at Harvard - the irony) & whoever made the Dinobabies comment will never get to the deposition table. How they are protected, I don't know. The orders came from the top (them), and a list of employees was made and given to HR. However, Rometty et al are blaming managers for firings. They said fire, and the managers picked the people. Those managers can be deposed. But the judges are letting these monsters get away with it if employees signed the agreements or they went passed the allotted 300 days. There are some tragic exceptions that should be allowed to piggyback off the cases. I hope they are able and can take IBM to the cleaners, but Rometty since to get away with literal murder.

In many cases you will see that they will send in a new manager just to do the dirty work. They'll set you up. It's a "scheme," clearly outlined in the Kinney vs IBM lawsuit. It's brilliantly written. You can have an MBA, sell millions then they'll switch you to clients that they know won't buy, give you wrong dates and times for meetings, and manufacture things they can use as an excuse to lay you off. 99% of the people laid off had great performance reviews, then suddenly they have "bad" reviews. Ironically, the people doing the firing are the same age as some of the employees but are in a "protected" group. Who isn't in a protected group? Older white men.

Rometty has some kind of God-given immunity. She does not have a compassionate bone in her evil body. I hope she pays for her sins as well as her partner in crime Diane Gershon & whoever created the Dinobabies term. I hope they all rot in the hell they created for everyone they laid off and the families they ruined.
