There is a point to this.
It isn't about a little data file, it is about companies asking if they can use your data, and respecting your decision. This is not a new concept, why should websites assume that it doesn't apply to the internet? No one wants to feel that they have been used, even if no harm comes from it.
My current beef is over cynical sites that parade compliance but strong arm users all the same. Those that say, "if you want to use this site, click that you accept cookies", rather than, "You don't need persistant cookies to use this site but this is what you will miss if you click "no thanks".
There is a real distinction between practical browser (or server) 'shopping trolly' - type cookies and tracking cookies. This distinction should be reflected in the regulations as this would help website owners understand that there is a point to this.
