The case of the McDonalds coffee was that the drink scalded her. The drink had been served at a temperature well in excess of what would reasonably expected i.e. I want to drink my coffee within minutes of getting it without having my mouth roasted.
Is what the i-pod plays outwith what is reasonable expected? Well, it does state what formats it plays on the box. And there are plently of other MP3 players out there that will take a wma (don't confuse 'popular' with 'monopoly').
At the end of the day it's a pointless debate. The case will be turfed out of court. This is a non story that affects no one.
I think it's likely this kit is going to shift a few more units then fail. In the real world, people who use Ubuntu are people who read El Reg and Nigerian school kids. My gran, my dad, my neighbour and my friends want to bung a DVD in the machine and play the “2 for £25” games they got out of HMV.
They don’t give a toss for root commands or any of that guff. If they knew enough about computers to even be aware of the existence of Ubuntu then half of us would be out of jobs.
People want to play “The Sims”.
What would happen if PC 'planet' got a pack of free CDs from Ubuntu ShipIt and put them on the shelf right by vista with a big sign saying, "Free Operating System", and a price tag of £0...
...is that everyone would still get Vista. People don't give a toss about their operating system.
Anyone who works in support knows that after 10 years of a broadly similar OS most people don't know where they're saving their files, edit word docs that are attachments then wonder why none of their changes are forwarded, and don't know the difference between shutdown, restart and log off.
People just want to check their e-mail and play "The Sims" and have a picture of their football team as their background wallpaper. Don't go expecting them to install their own OS. The just don't get it. The man on the street doesn't give a fig about whether we think MS sucks. It's the one in the box and it looks like the one at work.
I've never met anyone who wasn't a tech that upgraded their OS. The run with the one they get until the PC melts then they buy a new one and they got with that until they pour coffee in it. They don't care that Vista's a rip off. None of them will go out and buy it anyway.
