Unless you want to submerge it for more than half an hour or at more than 1 meter under water, it must be certified enough for your water resistance concerns...

Citizens from others Europeans countries which are full members of the Schengen agreement are -as far as i know- exempt of the latter, and can be expulsed only if convicted of crime or illegal activities.
