If a property own does not want the service it is not for the Authorities to intervene and force it upon them. Would they condone Landlords subsequent recover of full costs plus premium charges from the Tenants?

RedHat's biggest value was perhaps the disruption it caused in the OS market and the damage it inflicted on the bottom-line of the OS vendors as existed in the 90s, with the wider world benefiting from lower costs on server provision than would have otherwise been possible.

Now that most of the competitors have gone, and the general trend being a move to cloud that value was already fading - cloud vendors are full capably of building their own platforms, and on-premise is being undermined on price leading to a shrinking pool of potential customers. Yes there are other products in the line-up, but are they as mature revenue streams?

RedHat shareholders have timed this right, and got out just after the business's value has peaked.

Meanwhile IBM has repeated the mistakes we saw at HP and is in the process of blowing a fortune on an over-priced asset past its peak, while adding considerably to it's corporate debt bill. IBM shareholders have baulked at the move and may yet block the take-over. Even if it goes ahead, IBM is at high risk of a credit-ratings downgrade with consequent financial costs being another nail in the coffin.

Not to worry, all the current execs with still get their pay-offs, and lots of new Execs and BAs will be pulled-in over future years to try and fix the integration of a business with an alien corporate culture.

You would do better to look at the execution on the numbers - RedHat is not hitting it's targets and there are signs of trouble. These two businesses were both looking for a prop and the RedHat shareholders are getting out while the business is near it's peak.

The other possibility is that the take-over will be contested given that there is a risk that IBM shareholders will reject the offer.

A business such as SoftBank Group may find it a better proposition than say some of it's more recent investments given that RedHat has now been put into play in the market.

Read the briefs - the aim is clear, but neither business is hitting their targets. If they do not shape-up then there will be a shake-out.

Looking at the Red Hat numbers, I would not want to be an existing IBM share-holder this morning; both companies missing market expectations and in need of each other to get out of the rut.

It is going to take a lot of effort to make that 63% premium pay-off. If it does not pay-off pretty quickly, the existing RedHat leadership with gone in 18 months.

P.S.

Apparently this is going to be financed by a mixture of cash and debt - increasing IBM's existing debt by nearly 50%. Possible credit rating downgrade on the way?

Sorry, but no it is not.

Rape allegations are being used to destroy reputations and career advancement under the guise of protected identity.

It is months, possibly years before cases are brought to Court or thrown out. In the meantime the alleged offenders are subject to media and public recrimination, will likely loose their jobs and substantial impalement of income. Then when the allegations are brought to Court, if they get that far, a fair number of them are thrown out - all without prosecution of those making the allegations with their identities still protected and free to attack others again.

Recent numbers have show that only 1 in 56 cases of rape allegations in England and Wales lead to a conviction of the alleged criminal, yet those making the false allegations get off free.

In the case of Kavanaugh it clear from the start that it was a partisan subversion of the State to smear a SCOTUS candidate. You conveniently fail to mention that those involved in making these smear allegations are under investigation by the DoJ.

So the latest clarification is that he is suing both the Embassy and Ecuadorian Foreign Minster, in an Ecuadorian Court, to have the protocol over-turned on the basis that he was not consulted when the protocol was drawn up. Is that the full extent of the legal action?

Under the convention, Embassy officials are granted immunity, and are obliged to observe local laws but there are practical means of enforcing the law on those officials without the consent of the guest nation, other than to make an official unwelcome and to require then to leave.

Impact on Diplomatic Role

I am wondering how is latest actions will affect his current status; I am sure that Ecuador has a Code of Conduct for those it assigns a Diplomatic role - including bringing the nation's reputation into disrepute or similar. This may be all Ecuador need to make him "Persona non grata". The UK rejected his Diplomatic Status so he is more than likely to be arrested once outside the confines of the flat.

We can take this development as an indication that Assange is preparing himself for the inevitable.

He can bring the matter to a close - either by voluntarily handing himself over to UK Authorities, or by doing himself in - the latter option is the most effective in protecting Wikileaks from discoveries by investigations once under lock and key.

The other is the old fashioned method were an individual, long beyond their days of value and more an irritant, and disposed off in a suitably underhand way.

Either way, all parties concerned will be glad to see the end of this sorry little individual.
