What the California DMV is concerned with isn't really something the SEC would be interested in, and the SEC probably has their hands full with Musk related investigations already.

The SEC doesn't get involved with anything "that could affect the share price" because pretty much anything a publicly traded company does is. They are only concerned with actions taken to illegally manipulate stock price or profit from it. Mispresenting the capability of a product would fall under the remit of the FTC, but the rules for false advertising in the US are a much higher legal bar than in the UK.
