No, we approach that in a different way. It's already illegal to act solely on the basis of a flawed (discriminatory) algorithm.
The problem is the users completely misunderstanding what the tech is saying. It isn't a 97pc chance of a match, it's a 97pc chance that a human should look and decide if this is the same person as in whatever stored image they're comparing to.
