It's part of the Constitution. And if he could ignore one part, then what's to stop him ignoring certain others?
Certain segments of US society are really very keen on their Constitutional Rights. And are happy to loudly and vigorously proclaim how far they are willing to go to defend them. Trying to establish a precedent for ignoring them could be difficult...
