ZFS isn't in kernel mainstream because certain Sun developers specifically DID NOT WANT it to be (apparently there were resignation threats) and the CDDL was deliberately written to ensure llegal incompatiibility
You can't complain about that. It was their code, it was up to them to release it how they wanted. And no, they don't always work together nicely; there's certain people in the Linux kernel community who are keen on making certain symbols unavailable to the ZFS modulues.
