District Judge Fred Biery ruled that the "disability" provision in the state's vote-by-mail election code applies to all registered voters who "lack immunity from Covid-19 and fear infection at polling places." Texas' election code defines "disability" as "a sickness or physical condition that prevents the voter from appearing at the polling place on election day without a likelihood of needing personal assistance or of injuring the voter's health."

**Injuring the voter's health***, being the clear reason to vote by mail rather than vote in person.

e.g. 2 asymptomatic infectious people at a church service, resulted in the death of 4 people, 3 in the church and 1 in the community before CDC managed to lock it down.

This is clearly the likelihood of "injuring the voter's health" from the disability law, indeed there is a likelihood of *death* resulting from voting at a polling station in Covid times. It should be clear cut and in everyone's interest to encourage voting by mail, but as you'll see, Trump and Republicans and Fox will attack this as hard as possible.

If you're an old Texan, who watches the liars of Fox News, realize those 4 dead people were just like you, and they had a horrible death where they struggled to breath till they blacked out and died. This is you, if Fox News and the Republicans gets their way. This is what they want for you, so they can suppress the vote.

Watch the group attack this Texas decision. They'll quickly as they can move this up to Supreme Court and try to get a ruling to block all similar provisions that let voters vote by mail. Failing that they'll try for a stay on the order, and delay for the eventual decision until after the election date.

There are fallback options here, you could have a 'pre-filled' ballot. Where the ballot is filled in at home, then handed over at the polling station, reducing the wait times to zero. Even if the Supreme Court tries to kill mail-in ballots, there are ways of having an election despite their attacks on voting.
