They are not tardy about suing, even claiming complete ownership of things they derived from others. MS themselves was built on the dubious use of buying a reverse engineered CP/M 86 relabelled MS DOS and porting Dartmouth BASIC.
So without a court case, and MS wining it, it's the opinion of one MS employee even if it's true.
There is a problem with any alternate Windows. It needs to run all legacy code from Win3.1 16bit and Win NT3.1 32bit to 64bit Win 7, and very soon or there is no point to it, better to then use Linux and an XP or Win7 VM for legacy apps, or Win10 if you mysteriously can't migrate. Hence stupidity of some Linux Distro dropping 32bit Wine or making it tricky to install. For most users (not gamers), the whole point of WINE is the old 32bit programs that have never been updated and don't run on Win10 64 bit anyway.
