Independence comes at a cost
It's not just EULAs. Early in my career I wrote a scathing review of a really lousy modem in PC Magazine. The company sued for libel. Of course the truth is an absolute defense in libel cases, as long as you have $50,00 US to pay your lawyer.
The good news is that Bill Ziff paid the lawyers and indemnified me but it was a wake up call.
We've had projects go south, usually because the vendor asked for more than their system can do. What happens then depends on the vendor. Usually it means either redefining the project to be a consulting job on how they can fix their gear and nothing gets published.
