The EU has signed but not ratified the Agreement due to internal grumbling, but has also not made any move towards an Article 41 Withdrawal required to exit the Agreement. Ratification is proceeding in the rest of the World, meaning it is only a matter of time until ACTA is enacted, at which point the EU, having not come up with an alternative, will probably have to comply. Until then, there is existing German copyright and piracy legislation FinFisher can apply in Germany.
