Let's say I'm in a country that doesn't have such an extensive and draconian ban on porn.

So, technically, if I wanted to get someone in England into masses of trouble and hassle, all I have to do is whatsapp them an image. And there's literally no way they could get around it ... apart from changing all their msg/email apps to never download images or video again.

I should point out that I am a bastard, but not THAT much of a bastard.

Oh, it's worse. Consider how this entirely nukes any possible defensive action.

Imagine you have just received one of those dodgy images. What are you going to do?

1 - Delete them? Sure, but that's hoping it won't hide in a cache somewhere, a thumbnail, or those screenshots the iPhone takes to use during task switching. And it still may be logged by your friendly US exposed service like WhatsApp.

2 - Report it to the police? Although that would be IMHO a good way to go after the SENDERS, the problem is that this ruling leaves the RECEIVERS defenceless. The moment you walk into a police station with such a rapport, all it takes is a cop who prefers the statistic he can get now (you, the receiver) over possible hay tomorrow (the sender) and just decides to arrest you instead. Easily done, it gets the successful arrest score up and nobody cares about the bad guy that got away.

This establishes about as solid a method of entrapment and blackmail as publicly "investigating" someone for being a pedo (not accusing them, as that could lead to slander charges). Disgusting.
