back to article US court spanks porn company over credit card copyright suit

Perfect10 is at it again. The litigious porn purveyors have drawn yet another copyright decision out of the 9th Circuit Court of Appeals, this time concerning the liability of payment processors who provide services to infringing websites. After two recent, high-profile decisions that had mixed results for the dedicated …

    Perfect 10 RIAA of porn

So they have gone after the websites and credit processors. I'm sure the next step is to search the internet and p2p for unlicensed pics. They, in my mind, have solitified themselves as the RIAA of porn. It's only a matter of time till they go after people. I can see it now P 10 takes Grandmother to court over pics found in her temp internet cache file....With all this legal action they are taking I wonder how much money they are expecting to gain??? I wonder how much they have lost just in the legal bills???

    Consumer Terrorism

It looks as though the RIAA may have spawned a new version of an old scam for terrorising money out of innocent consumers. Remember one or two large companies that used to sell mail order records and books? They would send a selection each month wherein you were obliged to select only one to buy and then send the rest back and you could cancel at any time after an agreed period at no further obligation. Then, having canceled, one would find that these companies seemed never to get your cancelation notice and would continue sometimes for years to send unsolicited goods with demands for payment followed by threats from debt collection firms and possible county court action. I know of several people who simply gave in and paid just to avoid the complications that a county court action would have on their credit ratings.Consumer Terrorism. Now it seems the RIAA and this perfect ten are embarking on the new improved e-version.

    The blame game

So by their logic I could sue the company that makes the brick a thief may use to smash my car window? After all, without the brick that crime wouldn't have occurred! (Except of course, it probably would have still occurred, but without the brick...)

Or perhaps the treasury should be prosecuted for making the money that is used in drug deals? Everyone is to blame for everything!

    allofmp3 anyone?

Haven't Visa and MasterCard dug their own hole here?

They refused to let you pay to allofmp3 seeing our Russian friends infridged copyright. If I am not mistaken allofmp3 objected to no avail.

Now P10 is claiming the cardcompanies DO have an effect and again to no avail.

Perhaps I'm thinking to binary here.... but wouldn't either of these claims have to stick?

    Having your cake and...

Hang on just one festering second.

Didn't the major credit card companies force Allofmp3 out of business (ignoring their sparks clone) by refusing to process any payments for them ? Didn't they do that because the RIAA put pressure on them because they were seen to be aiding and abetting a music pirate - even when the case was still trundling through the courts ?

How is this any different ?

Re: allofmp3 anyone + Having your cake and...

Well, who is the RIAA and who is Perfect10? The former is a massive organisation with tentacles in every country (via the IFPI), which represents thousands of posh record executives who would hate to see their substantial income drain away. The latter is a piddly little porn peddler (no matter how tasteful, it remains porn to those who matter, i.e. judges).

Of course, if Perfect10 had engaged RIAA's lawyers, they could've made a case of it, but they chose to make a hash of it. And since it's porn in a country of prudes (Jackson, wardrobe malfunction, drama - you put them together in a sentence), it's therefor no surprise to see the judges rule in favour of the defendants.

    Double standards at work

This just shows how inconsistent the world of e-commerce is. Allofmp3 were forced out of business by the credit card companies, withdrawing their services under pressure from the RIAA. Yet in the wonderful world of porn, the credit card companies are not to blame for any copyright infringement.

Smacks of double standards and profit margin protection for the US based suppliers, but then again thats nothing new for the US of A.

    Ian + Anon

You are both quite correct. Except that it goes further than mere smacking of hypocrisy, it's "Right in your face ! How do like that, buddy ?" style.

    Perfect10?

Never heard of them. Thanks for the heads up... no pun intended.

Do they have the most "10" natural women around? As apposed to unnatural? 10 women models, 90 "woMen" models?

    I'm confused...

    What if they used cash?

In this case I agree with the Court. Allofmp3 was wrong. If Perfect 10 found that some one had mailed cash to a website that had copyrighted pics could they sue the US mail and treasury?
