back to article Cupertino must stop calling Apple Watches 'carbon neutral,' German court rules

A German court has told Apple to stop advertising its Watches as being carbon-neutral, ruling that this was misleading and could not fly under the country's competition law. Apple has been marketing its newest smartwatches as being carbon-neutral for nearly two years now, with an array of rationales. It claims that clean …

German courts are not fit for purpose.

      Well that didn't take long...

Would you care to enlighten us as to what purpose you feel they are unfit for, and exactly how? Try and keep the technical explanation simple please; I suspect that many of us here are not as educated in legal matters as you seem to be.

I’m sure Apple will appeal to SCOTUS and get this bigly set aside. Drill-Baby Drill anyway ….

Excuse me, but how would a German court care about SCOTUS?

Take a look at the unlawful reach of the Cloud Act for example… .in breach of GDPR for starters. The upcoming shitshow over Digital Seevices taxes as a second.

    No point in appealing

The BGH has already settled the point in the case against Katjes sweets – carbon neutral can only be used in advertising promotional materials if the entire production process is carbon neutral. Doesn't mean companies can't tout their green credentials – lots of them offer things like "planting one tree for every …".

But, yeah, eucalyptus trees planted in the wrong ecosystem are a disaster waiting to happen. They were planted in Portugal for the paper industry and are one of the factors in forest fires over the last few years: they're pyrophilic and produce highly flammable chemicals to encourage fires and help displace non-pyrophilic competition.

    Such hypocrisy

Oh, let me guess, it's the same judges which supported a ban on ad-blocking. Which would be ironic, since ad-blocking is proven to reduce carbon emissions.

I can't speak German, but even I can tell Bundesgerichtshof != Ordentliche Gerichtsbarkeit Hessen.

Fair point. However I found it was quite well concealed in the article's links, thus I wasn't aware of it until you pointed it out.
